Online Casinos in general: Declare crypto casino wins for tax purposes?

Hello everyone,

last year I won a total of just under 5 figures in crypto casinos. However, it was only this year that I realized that these casinos are not legal in Germany when I found out about taxes.

Is it smart to declare these wins as total crypto winnings on my tax return?
If I don't, it would actually be tax evasion.

At least a tax advisor and lawyer with whom I have written about this has advised me to declare the wins as other income or to declare the winnings in total as crypto winnings for tax purposes.

Any advice from you? Tax is due by 2.9 at the latest.

Thank you very much

hello,

i'm not from germany, but any kind of gambling win is tax-free (germany, austria, switzerland, etc...)

the only problem is that there has recently been a law in germany against Online Casinos without a german license are illegal and therefore you can be prosecuted

so in terms of taxes you are not liable to prosecution the win is taxed, but only because you played in an illegal casino......

PS why do you want to declare almost 5 figures, that's less than 10k ? you don't need to declare it anyway, do you?

Hello,

i've been reading a lot about this topic recently and just can't figure it out.
It often says online that the wins have to be taxed because they come from outside the EU and no taxes are paid by the casino to Germany when depositing. From time to time it also says something else online.

My problem is simple, I was really soooo stupid and only looked into it afterwards.
A tax advisor I wrote to online said I should declare the wins.

I just want to get out of this number...

No, no tax is due.
Unless you have still made wins on the rising price and these exceed €600.

And how do you know that? Has anyone at the tax office had this experience? Or is there something in writing about this? I'm now unsure whether I should just hand it in or not. And time is running out. Tax deadline ends soon

You can find enough on the net.

Of course, you can p**s on your own leg and tell them straight away that you played in casinos that are not permitted in Germany 🤦🏻

Please find a link to the ministry in Baden-württemberg (the rules are quite standardized and I am not aware of any differences): Here

Wins are tax-free whether they are legal or illegal does not really interest the FA as they are only responsible for collecting taxes but they must of course pass this on if they are aware of an illegal act

You are of course free to declare this as crypto wins on the course but then you would also be lying and paying taxes for something you have not earned at all so either way it is not very advantageous for you

But of course this is not binding advice and there is no guarantee what the right way is

But the letter doesn't say anything about online crypto winnings?

Then answer my question normally instead of sending something like that.

There is nothing in the letter because wins are always tax-free

So that's why you just assume that?

Oh so that's why you just assume that now?

What is there not to understand? Gambling winnings no matter where in what are tax-free here. Period.
