Good day to all,
i made several payments via Rapid Transfer back in 2020 on a weekend. Normally this is an instant transfer service Provider and debits directly from my bank account through my tan entry. However, this weekend was different and there was no money left in my account, so they apparently advanced the money and wanted to collect the money from my account the following Monday. But it was rejected by my bank because there was no money available. Now 1 1/2 years later they want to collect the money via a collection agency called "Sepa Collect".
It is about 300€ + 85€ handling fees. I have already received several demands in writing and wrote back that it was in the period when Online Casinos from my region were still illegal and refer to a court ruling from 2020. The ruling was against the payment service provider and was an equivalent case to mine. The collection company replied: "Our customer (skrill) is not responsible to check to whom the payment goes.

I know that there was already a thread here in the forum about a similar case, however, I would like to describe mine.

Next I think I will seek legal advice.

To my question: Does anyone have similar experiences and beyond perhaps even a result, whether the payment claim is legal or not?

Lg

Wouldn't an RA cost more than the claim? Pay it and you're done, after all, you also played with the money

Ui Ui. With such an attitude you make yourself very unpopular with all the soft flutes here. Always be nice against casinos and take the poor players in protection. Thank you.

The OP is clearly not to blame. Always the others.

Actually, you should know how much money you have in your account I can understand that you as a player such an opportunity can not really skip now but then please also pay your bills otherwise it can be very quickly interpreted as fraud because you will assume any judge that you know how much money you have in the account and there is usually only intent in question You have played with money that you have not paid back as agreed so see it as a loan with interest on arrears and pay that just the Debt collectors who work with Skrill like to take the chance and because of such a small amount you want no enforcement I had to pay once because of 60 € EC payment in the end 600 then you can like to extrapolate what your claim has for a potential if still the GV comes on board

I am not a lawyer either. If you have legal protection without a deductible, you can hire a lawyer. He will certainly be able to give you a recommendation.

Otherwise, it is not worth it for you from my point of view. It was your responsibility that the account was not covered.
The recipient is eig. beside the point. And if you know that it was illegal, you have deliberately done something illegal.

So it's best to pay, because the claim is justified and not invented, learn from it, and topic done.

Thank you for the helpful answers and also the negative, have shown me times ne other view on it. The problem is it's hard for me to feel empathy after 1 1/2 years, especially in the context of casinos. Any other creditor I would have sent the money immediately😁 Did not want to open a barrel here either.

Didn't want to open a can of worms here either.

The problem is without you now want to come stupid it will not interest the collection and Skrill whether you feel empathy for it or not their point of view is you got money you wanted to pay what you have not done then

And if they get a title they can claim the money from you for 30 years if you disagree it will go to the judge and they are not on the side of the debtor in case of direct debits/authorized payments especially since it is legal to Deposit money on Skrill and only the further use might have been illegal

So you have a legitimate contract with Skrill that must be fulfilled and if it goes badly then independently of this still problems because of illegal gambling

I can only repeat myself I would simply pay

Funnily enough, you didn't care about the illegality of the Deposit (you probably would if you made a decent win) and now that's your counterargument?

That's as if a craftsman would go to labor court because he got too little money for his moonlighting. (Although, meanwhile I can even imagine that would still get the right g*)
